Terms and Conditions - Landscapers Temple

Welcome to Landscapers Temple. By accessing, browsing, or using our services, you agree to be bound by the following Terms and Conditions. Please read them carefully before placing an order, requesting a service, or engaging with any content associated with our business. These terms are intended to create clear expectations, protect both parties, and outline the standards that apply to all landscaping services provided by Landscapers Temple.

These Terms and Conditions govern the use of our services for residential and commercial landscaping projects, including design, maintenance, installation, lawn care, planting, seasonal work, and related outdoor improvements. They may be updated from time to time to reflect changes in our operations, legal requirements, or service structure. Continued use of our services after any update means you accept the revised terms.

Acceptance of Terms

By requesting a quotation, approving a proposal, scheduling work, or accepting our services in any form, you confirm that you understand and agree to these Terms and Conditions. If you are acting on behalf of a company, property management group, or another organization, you represent that you have the authority to bind that entity to these terms.

If you do not agree with any part of these terms, you should not proceed with service requests or use our offerings. Use of our services implies acceptance of the terms stated here and any additional service-specific conditions communicated in writing.

Scope of Services

Landscapers Temple provides a range of outdoor property services. The exact scope of work depends on the agreed quotation, work order, site assessment, or written service agreement. Services may include:

  • Lawn mowing and turf maintenance
  • Garden design and planting
  • Tree, shrub, and hedge care
  • Seasonal cleanups and debris removal
  • Mulching and soil improvement
  • Irrigation-related support and adjustments
  • Hardscape and outdoor feature installation
  • General landscape enhancement and upkeep

All services are subject to site conditions, weather, material availability, and access to the property. Work will only begin after the scope is confirmed and any required approvals are received.

Estimates, Quotations, and Pricing

Any estimate or quotation provided by Landscapers Temple is based on the information available at the time it is issued. Prices may vary if site conditions differ from what was originally disclosed or if additional work becomes necessary. Quotations are not automatically binding unless clearly stated as fixed-price agreements.

We reserve the right to revise pricing if the project scope changes, if unexpected obstacles are discovered, or if material costs fluctuate. In such cases, we will make reasonable efforts to inform you before proceeding with the extra work. Transparent pricing is important to us, and we aim to provide clear explanations when changes are required.

Unless otherwise agreed, quotations may exclude taxes, permit fees, disposal charges, special materials, or third-party costs. Customers are responsible for reviewing all details carefully before approval.

Scheduling and Service Delivery

Service dates and times are arranged based on availability, project urgency, weather, and operational capacity. While we make every effort to meet scheduled appointments, timing may change due to factors outside our control. Weather delays, equipment issues, supply shortages, and safety concerns can affect completion dates.

If access to the site is limited, blocked, or unsafe, service may need to be postponed. It is the customer’s responsibility to ensure that the property is accessible at the scheduled time unless other arrangements have been confirmed. Any delay caused by site access problems may result in additional charges or rescheduling.

We may complete work in phases when a project is too large or when conditions require a staged approach. In such cases, all phase dates will be discussed in advance where possible.

Customer Responsibilities

To help ensure successful service delivery, customers must provide accurate information about the property, including any hazards, underground utilities, irrigation systems, pets, fragile items, or access limitations. Failure to disclose important information may lead to delays, damage, or additional charges.

Customers are also responsible for removing personal belongings, vehicles, furniture, ornaments, or other items that may interfere with the work area unless the arrangement explicitly includes handling those items. Any special instructions should be communicated clearly before the project begins.

  • Ensure safe and clear access to the work area
  • Provide accurate property and project details
  • Disclose known hazards and sensitive areas
  • Secure pets and supervise children during work
  • Review the scope before work starts

If customer actions or omissions create unsafe conditions, we may pause or stop work until the issue is resolved. Safety and accuracy are shared responsibilities that help protect people, property, and project quality.

Materials and Product Selection

When a project involves plants, soil, stone, mulch, irrigation parts, or other materials, the selection may be based on availability, seasonal suitability, and site conditions. Natural products can vary in appearance, size, color, or texture. These variations are normal and should not be considered defects unless a product is clearly damaged or unusable.

If the customer requests specific materials, brands, species, or grades, those preferences should be stated in advance and confirmed in writing. Substitutions may be necessary in some cases due to supply limitations or environmental suitability. When possible, we will offer an equivalent alternative for approval.

All plants and living materials are influenced by soil quality, irrigation, weather, sunlight, and maintenance. Because of these variables, outcomes may differ from one location to another. Living landscape elements require ongoing care and cannot be guaranteed in the same way as non-living materials.

Payments and Billing

Payment terms will be stated in the quotation, invoice, or service agreement. Unless otherwise agreed in writing, invoices are due upon receipt or within the specified payment period. Failure to pay on time may lead to work stoppage, additional fees, or suspension of future services.

Deposits may be required for larger projects, material purchases, or scheduled work. Deposits help reserve labor, equipment, and supplies. Unless stated otherwise, deposits are non-refundable once planning, ordering, or labor has begun. Progress payments may also be required for multi-stage projects.

If payment is not received by the due date, Landscapers Temple may charge reasonable late fees or recovery costs where allowed by law. Customers are responsible for all bank charges, returned payment fees, or collection-related expenses caused by failed or reversed payments.

Changes to Scope and Additional Work

Any request to change the approved work must be discussed and approved before the change is made. Changes can affect pricing, timelines, materials, and labor requirements. If additional work is identified during the project, we will notify the customer and seek approval whenever practical before continuing.

Examples of scope changes may include expanded planting areas, extra trimming, additional debris removal, modified design details, or upgrades to existing materials. Work not included in the original agreement may be billed separately. Verbal requests may be acted on in urgent situations, but written confirmation is preferred for clarity.

Weather, Site Conditions, and Delays

Outdoor work is affected by weather and environmental conditions. Rain, strong winds, heat, frost, frozen ground, drought, or unstable soil can all influence scheduling and performance. In some cases, work may need to be delayed to protect the property or ensure proper results.

We are not responsible for delays caused by conditions beyond our reasonable control. If severe weather or site hazards make it unsafe or impractical to proceed, work may be rescheduled. Customers understand that landscape performance can be affected by climate and local conditions, and that some seasonal variation is natural.

Where necessary, we may recommend postponing services to avoid damage, especially for lawn treatments, planting, or soil-related work. Such decisions are made in the interest of preserving quality and safety.

Quality, Revisions, and Limitations

We aim to deliver high-quality landscaping services that meet the approved scope and professional standards. If you believe there is an issue with the completed work, you must report it within a reasonable time after the service is finished. We may inspect the site, assess the concern, and determine whether corrective action is appropriate.

Minor variations in plant growth, color, and arrangement are not necessarily defects. Landscaping is a living, evolving service category, and results may differ due to seasonal changes and environmental factors. No guarantee can be made for outcomes affected by weather, neglect, pests, disease, animals, or third-party interference.

Revisions may be limited to matters that fall within the original agreement. Requests that go beyond the agreed scope may require separate pricing and scheduling.

Warranty and Guarantee Limitations

Any warranty or guarantee provided by Landscapers Temple will be stated in writing and may apply only to specific labor, materials, or installation work. Warranties do not cover damage caused by misuse, neglect, lack of maintenance, extreme weather, vandalism, or actions taken by others after completion.

Plants, turf, and natural materials are especially sensitive to conditions beyond our control. Therefore, any plant health or growth assurance will be limited by the terms disclosed in the specific service agreement. Routine maintenance is essential for preserving the appearance and health of any landscaped space.

Property Access and Risk

Customers grant permission for our team to access the property during scheduled service times. We may need access to water sources, electrical outlets, side yards, driveways, gates, or other work areas as required by the project. If access is restricted, the service may be delayed or incomplete.

While our team takes care to work responsibly, landscaping activities involve inherent risks, including moving equipment, sharp tools, heavy materials, and uneven surfaces. Customers acknowledge that some level of disturbance may occur during normal service operations. We are not liable for pre-existing issues, hidden defects, underground conditions not disclosed, or damage caused by factors outside our control.

Customers are encouraged to mark underground utilities, notify us of fragile structures, and remove valuables from the work area before service begins.

Cancellation and Rescheduling

If you need to cancel or reschedule a booking, please provide notice as early as possible. Cancellations made after scheduling resources, ordering materials, or assigning labor may result in cancellation charges. The amount of any fee depends on the work already performed and any costs we have incurred.

For large projects or repeat service plans, cancellation terms may be more specific and may require written notice. We reserve the right to reschedule work due to weather, emergencies, employee availability, or safety concerns. If we must reschedule, we will make reasonable efforts to arrange a new date promptly.

Intellectual Property

Any plans, drawings, designs, concepts, written materials, or proposals created by Landscapers Temple remain our property unless otherwise agreed. These materials may not be copied, sold, published, or reused without permission. This protects the originality and value of the work produced for each project.

Customers may use completed outdoor improvements on their property for personal or business use, subject to applicable agreements. However, the underlying design concepts and documentation remain protected unless ownership is specifically transferred in writing.

Termination of Service

We may suspend or terminate services if a customer fails to pay, provides false information, creates unsafe conditions, or repeatedly interferes with the agreed work. In such cases, any completed work and costs already incurred remain payable.

Customers may also choose to end a service relationship, subject to the applicable cancellation and payment terms. Any outstanding invoices, material charges, or approved work already performed must still be settled.

Limitation of Liability

To the fullest extent permitted by law, Landscapers Temple will not be liable for indirect, incidental, or consequential losses arising from the use of our services. This includes loss of enjoyment, business interruption, lost profits, or secondary damage not directly caused by our negligence.

Our total liability for any claim related to a specific service will generally be limited to the amount paid for that service, unless the law requires otherwise. This limitation applies even if we have been advised of the possibility of such damages. Nothing in these terms is intended to exclude liability where exclusion is not legally allowed.

Indemnity

You agree to indemnify and hold harmless Landscapers Temple from claims, losses, liabilities, and expenses arising from your misuse of our services, your breach of these terms, your failure to disclose critical site information, or your violation of any applicable law or third-party rights. This includes issues caused by unauthorized instructions or unsafe conditions created by the customer or others acting on their behalf.

Privacy and Data Use

Any personal information shared in connection with service requests, quotes, or billing will be handled in accordance with applicable privacy obligations. We use such information only for legitimate business purposes, including scheduling, communication, invoicing, and service administration.

We do not sell customer information as part of routine service operations. However, some information may be shared with trusted suppliers, subcontractors, or legal authorities when needed to complete work, comply with law, or protect our rights. Privacy and professionalism remain important in all customer interactions.

Governing Law and Dispute Resolution

These Terms and Conditions are governed by the applicable laws in the jurisdiction where the services are provided, unless a different rule is required by written agreement. If a dispute arises, both parties should first attempt to resolve it in good faith through direct communication and review of the relevant facts.

If informal resolution is not successful, further action may be taken in accordance with the laws and procedures available in the relevant jurisdiction. Each party agrees to cooperate reasonably to reduce conflict and resolve concerns in a fair and efficient manner.

Severability and Entire Agreement

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining sections will continue to apply. The failure to enforce any clause on one occasion does not waive the right to enforce it later.

These Terms and Conditions, together with any written quotation, invoice, proposal, or service agreement, represent the entire understanding between the customer and Landscapers Temple regarding the services described. Any prior discussions or informal statements are replaced by the written terms that apply to the project.

Final Acceptance

By engaging with Landscapers Temple, you confirm that you have read, understood, and agreed to these Terms and Conditions. We encourage all customers to review the terms carefully before approving work. Clear communication, fair expectations, and mutual respect help create a smooth service experience and high-quality results.

Landscapers Temple is committed to delivering reliable landscaping services while maintaining professional standards, customer trust, and attention to detail. These terms are designed to support that commitment and to ensure every project begins with clarity and ends with accountability.
